The history of the litigation funding industry has been brief, probably a little more than 10 years old. In that time frame, however, there have been many positive changes. The days of rates in excess of 10% a month, an unscrupulous investors have for the most part gone away and they have gone away because of intense market competition by well-run, well-funded companies, in addition to a greater acceptance by our industry of the legal community. In 2004, LawCash was one of the principle founders of the American Legal Finance Association or ALFA for short. ALFA was formed to provide the highest ethical standards in the industry. I was privileged to be its chairman for the first two years and currently serve as ALFA’s president. An ALFA member company must agree to a code of conduct of best practices that allow for greater transparency and documents in greater disclosure requirements for plaintiffs who have been involved in a long and protracted litigation. An ALFA member company may provide them with their daily living expenses while they await their case to go through the legal system.
